Right to work visual check in the UK has been extended

Recently, employers’ right to work checks has been changed by Home Office guidance. Due to the coronavirus pandemic, performing virtual checks on an individual’s right to work in the UK has been extended to 20th June 2021.

Retrospective checks are not required if you have got a right-to-work check under the temporary arrangements in place between 30 March 2020 and 20 June 2021. Effective from 21 June 2021, virtual checks on individual’s right to work will not be possible, whereas the employers will have to check applicants’ original right-to-work documents.

Carrying out Right to Work checks

There are two ways to carry out right to work checks

  1. Manual Check
  • Obtaining original acceptable documents
  • Checking the validity of the documents
  • Retaining a clear copy
  1. Online Check

Online checks can be done by using the online service on www.gov.uk

  • Use Home Office online right to work checking service
  • Confirm any photograph on the online right to work check is of the person presenting for work
  • Retaining a clear copy of the online right to work check response

Why a Right to Work Check is needed?

A Right to Work check is done to prevent illegal working. Before employing someone, the right to work check is done to ensure the individual is qualified for carrying out the work regarding their immigration status. Sanctions are imposed against illegal working, i.e. sanctions will be imposed when someone is found to be employing a person illegally and the right to work check is not carried out.

Examples Of Acceptable Documents:

  • Current Passport
  • A Registration Certificate or Document Certifying Permanent Residence issued by the Home Office.
  • A current Biometric Immigration Document (Biometric Residence Permit) issued by the Home Office.
  • A current Immigration Status Document issued by the Home Office.
  • A birth or adoption certificate issued in the UK.
